New Seller Disclosure Form Required Starting June 1st
As we shared previously, the Kentucky Real Estate Commission (KREC) is requiring all licensees to use the new Seller’s Disclosure form effective June 1, 2020.   This new Seller Disclosure form is now on Transaction Desk and available for your use.  The new form does not have to be updated for existing listings that already have a Seller Disclosure signed prior to June 1st.

At their May 21st meeting, KREC decided to delay disciplinary action related to use of the Guide to Agency Relationships, the Agency Consent Agreement - Buyer, and the Agency Consent Agreement - Seller forms. The Commission will be making changes to those three forms.  Until the changes have been finalized, licensees may use the newer version of these forms (available at www.krec.ky.gov) or they may continue to use the old version of these forms (available on Transaction Desk) without any disciplinary action.


We will update you on the status of these forms as soon as they are finalized by the commission.

Open Houses Can Resume with Conditions
The Kentucky Real Estate Commission (KREC) announced at their recent meeting that Open Houses can resume on a limited basis starting May 22.  KREC reported that guidance will eventually be posted on their website at www.krec.ky.gov.  In the interim, KREC noted that guidance would be based on the adherence to the Healthy at Work guidelines that Kentucky has produced for all businesses who are re-opening, which includes recommendations for groups no larger than 10, and recommendations coming from the Kentucky Department of Public Health.

FLEXMLS has also added Virtual Open Houses to the system.  If you utilize this feature, please remember MLS Rule 4.5 which prohibits any branding.

4.5 PHOTO/DOCUMENT/VIRTUAL TOUR PROHIBITIONS: Branding of photographs, documents and virtual tours is prohibited.  Virtual tours, videos, documents and photographs submitted to the MLS for display in listing information must exclude branded information.  Any tour accessed via a link posted in the MLS must exclude branding (i.e. YouTube videos). Examples of branding include visual, verbal or written information such as email addresses, website addresses, phone numbers, logos, and names.  Neither the tour itself, nor the surrounding frame, can be branded nor can branding be included in any photo remarks, file names, etc.

Advertising Regulation Update to Include Teams and Entity Names
At their May 21, 2020 regularly scheduled meeting, the Kentucky Real Estate Commission (KREC) discussed the implementation of advertising regulation changes that will be effective as of June 16, 2020. Fannie, Freddie Offer Forbearance Payback Guidelines
Mortgage financing giants Fannie Mae and Freddie Mac announced that homeowners in forbearance can request payment deferrals and tack any missed payments on to the end of their loan term, without penalty or added interest.  Read More.

Kentucky Statutory & Regulatory Changes Course - MAY 29

In response to the COVID-19 crisis we are offering the course, Kentucky Statutory and Regulatory Changes, via webinar on May 29th from 9am-4pm. BONUS: This course has now been approved for PLE credit. It counts as 4 hours of Contracts and 2 hours of Risk Management.
