FCC Postpones Telephone Consumer Protection Act One-to-One Consent Rule
|
|
|
On January 24, 2025, the Federal Communications Commission (FCC) postponed the effective date of the One-to-One Consent Rule.
The Rule was set to take effect on January 27, 2025. However, the Rule was being challenged in Insurance Marketing Coalition Ltd v. FCC, currently on appeal before the 11th Circuit Court of Appeals. The FCC decided to postpone the effective date of the Rule pending judicial review and will publish a new effective date in the Federal Register after the legal challenges have concluded, but no later than January 26, 2026. The FCC also postponed the effective date of a Second Text Blocking Report and Order which expressly extended Do-Not-Call Registry requirements and protections to text messages in addition to phone calls. Until further notice, the One-to-One Consent Rule will not take effect, but previous TCPA regulations issued by the FCC remain in place. Real estate professionals use telemarketing calls and texts to promote their services to
consumers, which can be an effective tool when implemented in compliance with relevant laws. The purported purpose of the Rule was to require that telemarketers and sellers of a product or obtain express written consent directly from the consumer, known as 1-to-1 consent, before using an ATDS or sending artificial or prerecorded voice messages. While the Rule may have been postponed, we still encourage you to join NAR's Legal and Advocacy Teams on Tuesday, January 28, 2025 from 2 – 3pmET for a joint webinar on the telemarketing Best Practices, the Telephone Consumer Protection Act (TCPA) and the proposed Rule. This webinar will provide real estate professionals with best practices to comply with the TCPA to reduce risk while successfully leveraging telemarketing calls and texts as a part of their promotional strategies.

Non-Deductible Member Dues Info for Your Taxes
|
|
|
The Tax Reform Act of 1993, as amended by the Tax Cuts and Jobs Act of 2017, made the portion of dues paid to organizations spent to lobby State and Federal governments non-deductible for income taxes, and requires that it be disclosed to members. GLAR: For 2024, Greater Louisville Association of REALTORS® (GLAR) computes 6.47% or $14.69 (of the $227 per member) to be non-deductible for the member’s income tax due to GLAR’s lobbying efforts on behalf of its members. Note that the entire $275.00 for MSI dues and $537.60 for CIE dues are fully
deductible.
KYR: For 2024, Kentucky REALTORS® computes 7.93% or $11.50 (of the $145.00 per member) to be nondeductible for the member’s income tax due to KYR’s lobbying efforts on behalf of its members. NAR: For 2024, with dues at $156 per member, the National Association of REALTORS® computes 35 percent or $55 to be nondeductible for the member's income tax purposes due to NAR lobbying efforts. Please note that the entire $45 Consumer Advertising Campaign special assessment qualifies as fully
deductible.

To access your member Account Activity Report for your Association related business expenses to use when preparing your taxes, please follow the steps below: 1. Go to www.louisvillerealtors.com, select Member Login at the top right of the page, and log in to your member portal. 2. Select “Pay Your Bill" 3. Select “View Paid and Unpaid Invoices" 4. Select “Account Activity Report" at the bottom of the screen. 5. For your “Account Activity Criteria” enter the dates (01/01/24 – 12/31/24), then select submit for your report.
